Conditions of use for the website

All use of this website (hereinafter called the ‘website’) is subject to the following conditions of use established by ROBINSON Hoteles España & Portugal.

General information concerning the website

1.1 ROBINSON Hoteles España Portugal provides all general information on the website purely as a guide to help users become oriented. General information is all information on the website with the exception of information which concerns travel services, prices of travel, taxes and/or any other mandatory legal information. The general information may be changed at any time. The user should therefore get in contact with the corresponding institutions, embassies or tourist information offices in order to establish that the information provided is up-to-date. This applies in particular to the requirements concerning entry into the country (identification papers, visas, etc.) and to the health regulations (e.g. compulsory injections) where ROBINSON Hoteles España & Portugal cannot be responsible for the information specific to the country concerned being either up-to-date and/or complete.                           
Robinson Hoteles España & Portugal accepts no liability for any information provided by third parties or for any contractual agreements which have been entered into with any third parties.

1.2 The information concerning the entry requirements and the formalities concerned with health regulations only apply to users who are citizens of the Federal Republic of Germany, the Republic of Austria and Switzerland, and only apply if you are in possession of identification documents issued by one of these countries. All other users should find out the relevant information concerning these matters, and if necessary find out about any regulations that are different from the consulate responsible or from a diplomatic representative.

2. Use of the website

2.1 The website is available for the personal use of user. Travel, flight and other services (hereinafter called ‘tourist services’) purchased from various third party organisations such as travel insurance firms, car rental firms, various travel businesses and tour operators, airlines, etc. (hereinafter called ‘providers’) may not be resold, transferred or passed on to any other further party in return for payment.

2.2 ROBINSON Hoteles España & Portugal reserves the right to refuse at its own discretion any access to the entire website or to parts of the website by users without any notice, and/or to cease to operate this website again without notice.

2.3 The website is only to be used in a legally permissible manner and as agreed upon, in particular with regard to adherence to these conditions of use. ‘As agreed upon’ in this case refers purely to the information concerning tourist services, to booking these services and to any other legitimate use of the functions installed upon this website.
This refers in particular to the following:

a) The user is financially responsible for all transactions which are conducted on the website under his or her name or using his or her account.
 
b) The user must be at least 18 years old and be sui juris.

c) The user must ensure the veracity of all information that he or she provides about himself or herself and/or about people travelling with him or her.

d) The website may not be used for the purposes of speculation, false or deceitful bookings, or for block bookings.

e) Any threats, use of duress, defamations as well as the transmission of any material which is pornographic, racist, inciting hatred between peoples, or which is anyway against the law and/or is discriminatory are expressly forbidden.

f) The website and its content may not be altered by the user, reproduced, transferred, sold, published or passed on in any other way. It is however permitted to prepare a copy of the page for one’s own private non-commercial use.

g) Files which contains software or any other material, which is subject to trademark rights or to copyright or which are subject to laws concerning privacy may not be put into circulation unless the user is entitled to use these rights, or the user has already obtained the necessary permission.

h) Files that contains viruses, corrupted files or software which could damage the operation of a computer belonging to a third party may not be copied.

i) Attributions of authorship, legal notices, descriptions of property, identifying marks which are contained in a file which as been loaded (software or any other material) may not be deleted or adulterated.

j) Goods or services may not be advertised or offered for sale. The use of questionnaires, competitions or chain letters may not be conducted and these items must not be passed on to others.

k) Access to the website may only take place via the corresponding home page. Access to other pages of the website requires the previous written permission of ROBINSON Hoteles España & Portugal (ROBINSON Hotels in Spain and Portugal). Links may not be presented by containing them within frames without the previous written permission of ROBINSON Hoteles España & Portugal.

2.4 The rules given in section 2.3 apply equally to any bulletin boards, blogs, chat rooms and other communication forums (known collectively as ‘forums’) on the website. All forums represent a public and not private form of communication. All content from third parties in these forums is neither scrutinised by ROBINSON Hoteles España & Portugal nor approved by it before it is added. ROBINSON Hoteles España & Portugal reserves the right to remove without notice any content from these forums that has been communicated by users or been sent by them.

2.5 The user is obliged to absolve ROBINSON Hoteles España & Portugal and further companies belonging to TUI AG, Hannover (hereinafter called ‘associated companies’), partner companies and staff at the first time of asking from any claims resulting from third parties (including the costs involved in an appropriate legal defence or prosecution) which are based on use of the website and its content by a user that is not in accordance with the agreed conditions, or are based on improper use of the website or upon use which is in any way illegal.

3. Links to other Internet pages

The website contains hyperlinks which lead to the Internet pages of third parties. ROBINSON Hoteles España & Portugal has no control over their form and content, and therefore cannot guarantee the correctness, completeness and/or the content of the information that is presented there, nor can it guarantee how up-to–date the information is.

4. Changes to the website

ROBINSON Hoteles España & Portugal reserves the right to make changes to the website and/or its content. This particularly concerns their choice of providers, the range of functions, information, databases and /or their content.

5. Copyright and trademarks

5.1 ROBINSON Hoteles España & Portugal is the holder of the copyright and all other trademark rights on the website and its contents. All content of the website is owned exclusively by ROBINSON Hoteles España & Portugal and its associated companies unless the copyright holding by a third party is specifically indicated. The name ROBINSON Hoteles España & Portugal and all trademarks, logos and graphics belonging to ROBINSON Hoteles España & Portugal and other companies that are part of the TUI concern on the website are registered trademarks of TUI AG.

5.2 ROBINSON Hoteles España & Portugal is entitled to use the trademarks of trademark holders who are not associated companies.

5.3 The user has no right to use the trademarks mentioned in sections 5.1 and 5.2 and is not licensed to use them.
